In most cases, the question only arises in old age, but often enough also at a young age as a result of accidents or mental illness: What happens if you are no longer mentally capable of making necessary decisions on your own or taking care of everyday business? In general, if a person becomes incapacitated, a guardian is appointed by the court. He or she carries out the legal transactions for which he or she has been appointed by the court on behalf of the person for whom he or she has been appointed.
With a health care proxy, you can decide for yourself who may act on your behalf in the event of your legal incapacity. You decide for yourself who is the person you trust. You decide who can make which decisions and carry out which transactions on your behalf. You decide when this power of attorney comes into force and how long it is valid. Of course, a health care proxy can also be registered in the Austrian Central Register of Representatives. This can also be used to register when a power of attorney becomes effective, who you appoint as guardian if necessary, which relatives you do not wish to be represented by and, of course, the conditions under which you can revoke a power of attorney. This registration allows the court to determine at any time within seconds whether a health care proxy exists or whether a guardian must be appointed.
